We represent clients seeking to overturn trial court rulings and clients defending favorable decisions. Our appellate practice includes Alabama’s appellate courts and federal courts of appeals, with reported matters involving commercial disputes, property rights, oil and gas interests, and governmental action.
Briefing and post-judgment work
We evaluate the trial record and the governing authorities, identify the issues for review, and develop the written and oral arguments. Our work includes appellate briefs, oral argument, post-judgment motions, and applications for rehearing.
An appellate engagement may follow a trial, an earlier ruling, or a referral from existing counsel. We assess the procedural history and legal questions at the outset so the client understands the scope of the proposed work.
Working with trial counsel
We handle appeals arising from the firm’s own cases and work with attorneys who seek appellate counsel for their clients. In referred matters, we coordinate with trial counsel on the record, prior proceedings, and the issues to be presented.
Reported appellate matters
Jefferson County occupational tax litigation
Representation of the taxpayer class in litigation before the Alabama Supreme Court, including Jefferson County Commission v. Edwards.
Real property and boundary disputes
Representation in Gilbreath v. Harbour, a reported Alabama Court of Civil Appeals matter involving a boundary dispute, adverse possession, and a driveway easement.
Preparing for a consultation
